As a parent/guardian of the child(ren) named herein, I hereby acknowledge that we voluntarily applied to participate in baseball activities in conjunction with 316 Baseball Academy, Inc. I am aware that serious accidents occasionally occur during baseball game and practice activities; and that participants and observers occasionally sustain serious personal injury or death and/or property damages, as a consequence thereof. I understand that included among the dangerous elements of the sport of baseball is the risk of injury as a result of being struck by a batted or thrown ball, a loose bat, or by a player’s equipment or equipment of facility. Additionally, I understand that there is a risk of injury to head, neck, face, eyes, mouth, arms, mouth, hands, fingers ankles, feet, toes, knees and legs while participating in or observing baseball activities. I understand that in addition the above-mentioned risks, there are unpredictable dangers involved in this sport.
In consideration for being allowed to participate in baseball game and baseball practice activities or to observe these activities in conjunction with 316 Baseball Academy, Inc. I intend to be legally bound, do herby for myself, my heirs, executors, and administrators waive and release any and all rights and claims for damages I may accrue against 316 Baseball Academy, Inc. its employees, officers or representatives and all sponsors for any and all injuries that may be suffered by me as a result of my participation in baseball activities.
Further, I will assume my own medical and emergency expenses in the event of an accident or other incapacity or injury resulting from or occurring from my participation.
This release is intended to discharge in advance, 316 Baseball Academy, Inc., (including its respective coaches, agents, officials, employees, affiliates, and school districts where facilities are used), and the sponsors from and against any and all liability arising out of or connected in any way with my participation in or observation of baseball events; even though the liability may arise out of active or passive negligence, or carelessness on the part of the persons or entities mentioned above.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious. Regardless, 316 Baseball Academy, Inc., its employees, officers or representatives and all sponsors cannot guarantee that visitors or participants will not become infected with COVID-19. Further, participating in activities or attending practices and/or games and events sponsored by and/or endorsed by 316 Baseball Academy, Inc. could increase the risk of contracting COVID-19.
By signing this consent, I, the undersigned, acknowledge and assume the risks associated with COVID-19 and that my child(ren) and I may be exposed to or infected by COVID-19 by either participating or spectating in any activities, events, or services provided by 316 Baseball Academy, Inc., and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I understand that the risks of becoming exposed to or infected by COVID-19 through my participation in 316 Baseball Academy, Inc. activities may result from the actions, omissions, or negligence of myself and others, including, but not limited to, 316 Baseball Academy, Inc. owners, contractors, employees, and participants and their families. I further understand that 316 Baseball Academy, Inc. is unable to control or reduce the exposure of COVID-19 to my child(ren) and family at any location or facility owned, leased, and/or operated by a third-party and/or at any event, tournament, game, or other activity
As a parent/guardian of the child(ren) named herein, I hereby represent that the child(ren) has been examined by a physician and is physically fit to participate in 316 Baseball Academy, Inc. programs.
I further understand fully and agree that the term of this release extends from year to year, covering all periods of time that I participate in baseball activities in conjunction with 316 Baseball Academy, Inc.
In the event that I cannot be reached in an emergency, I hereby give permission for care to be administered by a qualified 316 staff member, EMT, physician/staff of a hospital, or any other qualified individual to provide any medical treatment deemed necessary for my child.
YOU MUST BE THE PARENT OR LEGAL GUARDIAN TO SIGN FOR A MINOR CHILD (UNDER 18 YEARS OLD)
